HLS® Limited Lifetime Finish Warranty
Each HLS® product sold by HOPPE North America, Inc. (a “Product”) is warranted against red rust for the life of the Product as long as the Product is used in the location in which it was originally installed. Proof of original purchase is required to make a claim under this Limited Warranty.
This Limited Warranty does not cover discoloration on finishes if 300 series Stainless Steel Screws are not used. This Limited Warranty does not extend to finishes or surfaces intended to change color or appearance by design. This Limited Warranty excludes normal wear and tear, damage caused by scratches or abrasions and Product (1) that has been altered, improperly installed, abused, vandalized, and/or misused; (2) used in commercial applications; (3) that has been damaged by acts of nature or by fire; (4) that has not been properly maintained in accordance with the manufacturer’s written specifications; or (5) that has been exposed to solvents, chemicals, or other harsh environments or foreign substances including any airborne foreign substances. This Limited Warranty is expressly limited to those persons or entities that purchase the Product directly from HOPPE North America, Inc. for their own use or for resale in their ordinary course of business.
If any Product is found to be defective by HOPPE North America, Inc. in its reasonable judgment, HOPPE North America, Inc. will, at its option, either repair or replace the defective hardware. This Limited Warranty does not cover any labor charges to remove and/or reinstall a Product.
THE FOREGOING LIMITED WARRANTY IS EXCLUSIVE AND HOPPE NORTH AMERICA, INC. MAKES NO WARRANTY WITH RESPECT TO ITS PRODUCTS, EXPRESSED OR IMPLIED, EXCEPT AS SET FORTH HEREIN. ALL OTHER EXPRESSED WARRANTIES, AND ALL IMPLIED WARRANTIES (INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE), ARE HEREBY DISCLAIMED. ANY ORAL OR WRITTEN DESCRIPTION OF HOPPE NORTH AMERICA, INC.’S PRODUCTS IS FOR THE SOLE PURPOSE OF IDENTIFYING THE PRODUCTS AND SHALL NOT BE CONSTRUED AS AN EXPRESS OR IMPLIED WARRANTY.
HOPPE NORTH AMERICA, INC.’S LIABILITY, WHETHER IN CONTRACT, NEGLIGENCE OR OTHER TORT, STRICT LIABILITY OR UNDER ANY OTHER LEGAL THEORY, ARISING OUT OF WARRANTIES, ACTIONS, OMISSIONS, REPRESENTATIONS, INSTRUCTIONS OR WARNINGS (OR LACK OR INADEQUACY THEREOF), DEFICIENCIES, FAILURES, OR DEFECTS OF ANY KIND OR FROM ANY CAUSE SHALL BE LIMITED SOLELY TO REPAIRING OR REPLACING DEFECTIVE PARTS PURSUANT TO THIS LIMITED WARRANTY.
